AGREEMENT TO TERMS

Welcome to GeniusX! These Terms of Service & Use ("Terms") govern your use of GeniusX's services, applications, and website (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.These Terms form a binding legal agreement between you (the "User" or "Customer") and GeniusX ("we," "us," or "our").

DEFINITIONS

Service: Any software, tools, applications, and platforms provided by GeniusX.

Subscription: A subscription plan granting access to GeniusX features.

Account: A registered profile of a user that grants access to the Service.

Content: Any information, files, text, graphics, or data uploaded or generated in the Service.

Affiliate: An individual or party referring new users to GeniusX via an approved link.

ELIGIBILITY

In using GeniusX, you will:

Be at least 13 years old.

Provide accurate and complete registration details.

Use the Service solely for lawful purposes.

SUBSCRIPTION, BILLING & PAYMENT TERMS

1. Subscription Management

Subscriptions are handled by the users at Account Dashboard > Settings > Subscription Management:

Switch to higher or lower plans.

Modify billing details.

Cancel accounts.

See payment history.

2. Billing and Auto-Renewal

Subscriptions will renew automatically until canceled before the renewal date.

Monthly or annual plans.

No refund of processed payments.

Cancellation preserves access via the billing cycle termination.

3. Free Trial

New members are provided with a 14-day free trial before subscribing to a paid plan.

Members must cancel within the trial period in order to avoid charges.

ACCEPTABLE USE POLICY

Prohibited Uses

Users are not permitted to:

Engage in fraudulent, illegal, or deceptive practices.

Reverse-engineer, alter, or redistribute GeniusX software.

Resell, lease, or sublicense GeniusX without authorization.

Interfere with the security of the Service.

Upload viruses, malware, or malicious code.

Use the Service to promote hate speech, violence, or discrimination.

Access another user's data without permission.

DATA OWNERSHIP & PRIVACY

1. User Data

Users retain full ownership of their data entered into GeniusX.

Data backups and exports are located at Settings > Backup & Restore.

When a subscription is cancelled, data access is restricted but not deleted.

2. Data Retention

User data is retained for 3 years of account inactivity.

Members may delete their accounts and data permanently.

3. Security

We follow industry-standard security and encryption practices.

GeniusX will be not liable for loss of data caused by negligence of user, unauthorized access, or system failure which is outside our control.

INTELLECTUAL PROPERTY

All the information, including text, graphics, logos, and software, is the property of GeniusX and is protected by copyright and other intellectual property rights.

Users are granted a non-transferable, non-exclusive, limited license to use our services.

Copying, modification, distribution, or sale of any part of our services without our express written authorization is not allowed.

TERMINATION & ACCOUNT SUSPENSION

1. Account Termination Reasons

We may terminate accounts for:

Policy violations.

Fraudulent activities.

Non-payment.

Inactivity for a long time (3 years).

2. Termination Notice

Users will be informed via email, in-app messages, and banners before account deletion.

AFFILIATE & RESELLER POLICY

Members are entitled to a 5% referral fee for introducing new paying members.

Referrals must only be made using approved affiliate links.

There are no white-label or reseller programs available for GeniusX.

LIMITATION OF LIABILITY

GeniusX is not liable for indirect, incidental, or consequential damages.

Members are responsible for the accuracy of their input data.

GeniusX is not liable for losses as a result of incorrect data input that results in business or contract disputes.

INDEMNIFICATION

You indemnify and hold GeniusX harmless from any claim, damages, liabilities, and costs arising from your use of our services, violation of these terms, or violation of any rights.

DISPUTE RESOLUTION

Disputes will be resolved by binding arbitration based on the rules of an accepted arbitration agency.

Users waive the right to class-action lawsuits.

GOVERNING LAW

These Terms are controlled by the laws of USA, UK, Oman, and relevant international SaaS laws.

CHANGES TO TERMS

We can modify these Terms at any time. Any modifications will be published on this page. It is your duty to periodically review these Terms.
