Agreement to terms

Welcome to GeniusX! These Terms of Service ("Terms") govern your use of GeniusX's services, applications, and website (the "Service"). By accessing or using the Service you agree to these Terms; if you do not agree, do not use the Service.

Definitions

• Service: Any software, tools, applications, and platforms provided by GeniusX.
• Subscription: A plan that grants access to GeniusX features.
• Account: A registered profile that allows access to the Service.
• Content: Any information, files, text, graphics, or data uploaded or generated in the Service.
• Affiliate: An individual or organisation who refers new users to GeniusX through an approved link.

Eligibility

By using GeniusX, you confirm that you:

• Are at least 13 years old.
• Provide accurate and complete registration information.
• Use the Service only for lawful purposes.

Subscription, billing & payment

Subscription management

Manage your plan inside Account Dashboard > Settings > Subscription Management:

• Upgrade or downgrade plans.
• Update billing details.
• Cancel an active subscription.
• Review payment history.

Billing and auto-renewal

• Plans renew automatically unless cancelled before the renewal date.
• Monthly and annual options are available.
• Processed payments are non-refundable.
• Cancelling keeps access until the current billing cycle ends.

Free trial

• New members receive a 14-day free trial before paying.
• Cancel during the trial to avoid charges.

Acceptable use policy

Prohibited uses

Users are not permitted to:

• Engage in fraudulent, illegal, or deceptive practices.
• Reverse-engineer, alter, or redistribute GeniusX software.
• Resell, lease, or sublicense GeniusX without authorization.
• Interfere with or compromise Service security.
• Upload viruses, malware, or malicious code.
• Use the Service to promote hate speech, violence, or discrimination.
• Access another user's data without permission.
• Overload or disrupt system performance.

Data ownership & privacy

User data

• Users retain ownership of the data they enter into GeniusX.
• Backups and exports are available via Settings > Backup & Restore.
• Access may be restricted if a subscription lapses but data is not deleted automatically.

Data retention

• User data is retained for up to three (3) years of inactivity.
• Members can permanently delete their accounts and data.

Security

• Industry-standard security and encryption measures are applied.
• GeniusX is not liable for data loss caused by user negligence, unauthorised access, or external failures beyond our control.

Intellectual property

• All text, graphics, logos, and software belong to GeniusX and are protected by intellectual property laws.
• Users receive a non-transferable, non-exclusive, limited licence to use the Service.
• Copying, modifying, distributing, or selling any part of the Service without written consent is prohibited.

Termination & account suspension

Account termination reasons

• Violations of these Terms.
• Fraudulent or harmful activity.
• Repeated non-payment.
• Extended inactivity (three years).

Termination notice

Users are contacted via email, in-app messages, or banners before an account is deleted.

Affiliate & reseller policy

• Members may earn a 5% referral fee for new paying customers.
• Referrals must use approved affiliate links.
• GeniusX does not offer white-label or reseller programmes.

Limitation of liability

• GeniusX is not liable for indirect, incidental, or consequential damages.
• Members are responsible for the accuracy of information they submit.
• GeniusX is not liable for disputes arising from inaccurate data entry.

Indemnification

You agree to indemnify and hold GeniusX harmless from claims, damages, liabilities, and costs arising from your use of the Service or violation of these Terms.

Dispute resolution

Disputes arising under these Terms will be handled through arbitration in the jurisdiction of GeniusX's primary business location.

Modifications to terms

• GeniusX may update these Terms when necessary. Changes take effect upon posting.
• Users are notified via email and in-app messaging about material updates.
